1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and TCG Scope ("we," "us," or "our") governing your access to and use of the website located at tcgscope.app and all related services (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Service.

You represent that you are at least 13 years of age. If you are under 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

2. Description of Service

TCG Scope is a monitoring and analytics tool that tracks publicly available eBay listings and auctions for trading card game (TCG) products. The Service provides price tracking, grading certification verification, population report data, and notification features.

TCG Scope does not sell, buy, broker, or facilitate the transaction of any items. The Service is strictly an informational tool. All purchasing decisions are made solely by the User on third-party platforms such as eBay.

3. Accounts

To use the Service, you must authenticate via Clerk, our third-party authentication provider. You may sign in using Discord, Google, or your email address. You may also link multiple sign-in methods to a single account. You are solely responsible for maintaining the confidentiality and security of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

We do not store your password. Depending on your sign-in method, we may receive and store your username, email address, and profile image from the authentication provider. See our Privacy Policy for details.

4. Prohibited Conduct

You agree that you will not, and will not permit any third party to:

• Use the Service for any unlawful, fraudulent, or harmful purpose
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying data structures of the Service
• Scrape, crawl, harvest, or use any automated means (including bots, spiders, or scripts) to access the Service or extract data from it
• Resell, sublicense, redistribute, or commercially exploit any data, content, or functionality obtained through the Service
• Create a competing product or service using information obtained from the Service
• Attempt to gain unauthorized access to any portion of the Service, other users' accounts, or any systems or networks connected to the Service
• Interfere with, disrupt, or impose an unreasonable burden on the Service or its infrastructure
• Circumvent, disable, or otherwise interfere with any security, rate-limiting, or access-control features of the Service
• Use the Service to manipulate markets, engage in price fixing, or conduct any form of fraud
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

Violation of this section may result in immediate termination of your account and may subject you to civil and/or criminal liability.

5. Intellectual Property

The Service, including but not limited to its source code, design, user interface, algorithms, data aggregation and processing methods, database structures, proprietary data pipelines, pricing models, and documentation, is the exclusive property of TCG Scope and is protected by copyright, trade secret, and other intellectual property laws. All rights not expressly granted herein are reserved.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only, subject to these Terms. This license does not include the right to copy, modify, distribute, sell, lease, or create derivative works based on the Service or any part thereof.

"TCG Scope" and associated logos and marks are proprietary to us. You may not use our name, logos, or branding without our prior written consent.

5A. Enforcement and Remedies

You acknowledge that any unauthorized use, reproduction, reverse engineering, or misappropriation of the Service, its features, data pipelines, algorithms, or proprietary methods would cause irreparable harm to TCG Scope for which monetary damages alone would be an inadequate remedy. Accordingly, you agree that TCG Scope shall be entitled to seek injunctive or other equitable relief (without the obligation to post any bond or surety) in addition to any other remedies available at law or in equity.

In the event that TCG Scope prevails in any legal action arising from your violation of these Terms, you agree to pay all reasonable attorneys' fees, court costs, and expenses incurred by TCG Scope in connection with such action.

TCG Scope reserves the right to pursue all available legal remedies, including but not limited to claims under the Computer Fraud and Abuse Act (CFAA), the Digital Millennium Copyright Act (DMCA), the Defend Trade Secrets Act (DTSA), and applicable state trade secret and unfair competition laws, against any person or entity that engages in prohibited conduct under Section 4 or infringes upon TCG Scope's intellectual property rights under Section 5.

6. Third-Party Data and Services

The Service aggregates and displays publicly available data from third-party sources including, but not limited to, eBay, PSA (Professional Sports Authenticator), and Beckett Grading Services. We are not affiliated with, endorsed by, or sponsored by any of these third parties.

We make no representations or warranties regarding the accuracy, completeness, reliability, or timeliness of any third-party data displayed through the Service. Pricing data, population reports, grading information, and market analytics are provided for general informational purposes only.

Nothing in the Service constitutes financial, investment, or purchasing advice. You are solely responsible for your own purchasing and investment decisions.

7. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components. We do not warrant that the results obtained from use of the Service will be accurate or reliable.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall TCG Scope, its operators, affiliates, licensors, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with your access to or use of (or inability to access or use) the Service, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising out of or relating to the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim, or ten dollars (US $10.00), whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless TCG Scope and its operators, affiliates, officers, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any content or data you submit or transmit through the Service.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason or no reason, with or without notice. Upon termination, your right to use the Service ceases immediately, and we may delete your account and associated data.

Sections 4 through 9 and 12 shall survive any termination of these Terms.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Effective date" at the top of this page and may notify you through the Service. Your continued use of the Service after any modification constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in the United States, and you consent to the personal jurisdiction of such courts.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and TCG Scope regarding your use of the Service, and supersede all prior and contemporaneous understandings, agreements, and communications regarding the same.
